Legal Environment of Business and Employment Coursework

Legal Environment of Business and Employment - Coursework Example In order to determine whether there was a valid legal contract between A2Z Co. Ltd and Bling Stores and to best advice the parties it is necessary to discuss the above mentioned essential elements for formation of a contract and how the presence of each element is achieved. An offer has been defined as an expression of willingness by one party known as the offeror, to contract or be bound on stated terms, provided that such terms are accepted by the party to whom the offer is made that is the offeree. The courts have drawn a distinction between an offer and an invitation to treat, as the latter is merely an expression of willingness by one party to enter into negotiations and is not unconditional and there is a lack of intention to create legal relations. The most important and land mark cases which distinguished between an offer and invitation to treat are of Gibson v Manchester City Council1 and Storer v Manchester City Council2. In Gibson, where treasurer had sent a letter to Mr. Gibson, stating that council may be prepared to sell the house, was held to be an invitation to treat, which was further confirmed by the fact that Mr. Gibson was asked to make a formal application to purchase the house. The courts therefore took into account the correspondence between the parties. However, in Storer the courts found that a contract had come into existence as negotiations had moved beyond what had happened in Gibson but an exchange of contracts had not taken place. These cases clearly point out that fact that judges can interpret and differ in the results and so the decision would be said to be based on its own facts. The next step is that of acceptance. The general rule for the acceptance of an offer is that the offer should be accepted unconditionally and must be communicated to the offeror. (Holwell Securities v. Hughes3). However there are certain exception to this general rule and one of them is the infamous postal rule. The postal rule states that when an acce ptance is sent by means of a post, it takes place as soon as the letter is validly posted. (Adams v. Lindsell)4, furthermore Instanta Instantaneous modes of communication has lately been scrutinized by the courts (Lord Wilberforce in Brinkibon Ltd. v Stahag Stahl GmbH)5, however the problem of when acceptance is effective has clearly not been addressed and still lies in an area of uncertainty. instantaneous modes of communication has lately been scrutinized by the, however it is a settled law that a communication made through instant mode of communication is deemed effective if it is despatched and received during working hours i.e if a fax is sent on Sunday evening it will only deemed to be effectively communicated on Monday morning, when office working hours start. Acceptance must be looked into carefully, as the fact that it must be unconditional is strict and so if new terms and conditions are introduced that would not be acceptance and would merely be a counter offer, which can then be accepted by the original offeror, who now becomes the offeree as in (Hyde v Wrench)6.If the offeree does not accept all the terms and conditions proposed by the offeror and introduces new terms to the original offer is not an acceptance but a counter offer which kills the original offer The general rule for acceptance is that communication must actually be made to

A Managerial Strategy Essay Example for Free

A Managerial Strategy Essay The principal purpose and function of healthcare organizations is to ensure that their services. Above all their duties is geared towards caring for their patient’s health and emphasize the ability of the organization to serve their patients skillfully and responsibly. Further, they offer different types of services which include medical and behavioral health care services, accordingly, this includes public and community health care programs and in the contemporary scenario, corporate power. As a matter of fact, it has been stressed in The Well-Managed Healthcare Organization that in order to ensure that a healthcare organization is really doing its task of safeguarding the health of its patients (and not really attracting them to be its client), a health organization should improve the quality of its services (Griffith White, 2006), which strengthens the argument of harnessing the managerial skills of healthcare practitioners. Moreover, it should also maintain a well-facilitated plant in which the patients are being accommodated.   Given with such instances, it highlights the perception that healthcare organizations are mandated to implement certain administrative methods to meet the mounting complications derived over by societal challenges (Griffith White, 2006). One of the cited feasible and efficient techniques in achieving managerial success is proper organization of the activities and the developmental plan of the entity.   It is through the alignment of program objectives that the goals are obtained and prevents the rise of problems which deals with conflicts or miscommunication. If the programs are aligned well, then the members of the organization shall have a clear vision on what to expect, and oversee necessary changes so as to improve their performance.   Simple logic basically revolves in the verity of the strategy; common problems arise when the organization has no definite goals which lead to disorientation. Similar to that of business entities, healthcare practitioners must also take the challenge of facing the waves of managerial confrontations. Reference Griffith, J. R., White, K. R. (2006). Educational Philosophy :: essays research papers

My Educational Philosophy Education is the foundation of human interaction. School is where students take in knowledge that will determine what they do with the rest of their lives. Students are offered great opportunities through education. Many times these opportunities are largely affected by how the material is presented to them. As an educator one is given the opportunity to facilitate the learning of these students and affect their lives in hopes that they use this information to progress forward into the future. My goal as a teacher is to educate the future generations of America. I want to be a teacher because teaching is a unique occupation that will provide me with intrinsic rewards. I have found that the students have a large impact on how much I appreciate the art of teaching. I feel that teachers that have stable and healthy relationships with their students are the most successful. Throughout my student teaching experiences I have genuinely strived to be respectful towards all my students and each of their differing learning behaviors. All students learn at different paces, and work better with some learning styles rather than others. This does not mean that students should be left behind because an educator prefers certain learning styles over one another. A good teacher attempts to you all types of learning styles in order to reach out to all types of learners. One can do this by touching on all aspects of Gardner’s multiple intelligences theory when creating lessons. I believe that assessment in the classroom should be constant. Student should have the chance to be graded beyond the simple tests and quizzes. Presentations, class discussions and other ways that students can prove that they are comprehending the presented knowledge is important and should be noted. I am quite passionate about my content area, teaching allows me to communicate and share that knowledge with my students. Social studies cover so many areas: history, political science and the social sciences. I find each of these areas to be quite fascinating as well as lessons and skills that the students learn in these classes that they will use in the rest of their lives. The challenge and reward that comes from understanding the cognitive level of adolescent students is what makes me prefer working on the secondary level. A teacher is more that just a facilitator of knowledge. A great teacher is one that fulfills all of the following roles: educator, mentor, role model, authority figure, planner, assessor, counselor, as well as a peer.

Nursing Home

Previously, availing of a health care service was a great concern on the part of the patients. Some of the possible common concerns are poor number of health professionals, non availability of treatments and even inaccessible domains from which to acquire health services However, due to the development of various initiatives to make health care conveniently available, one of the most promising alternatives for the elderly population is to avail of the nursing home services.Nursing home service can be seen as an integral part of health care institutions today. This segment of providing quality health care has been realized so that people who need to get medical and health attention outside of the hospital premises can still obtain the most needed service. Nursing and health professionals can now have special arrangements to be designated in various households in which care is needed for special reasons. One very practical ground is the physical limitation of the patients especially th e elderly.Do elderly people will really benefit from the nursing home program? One good approach is to see the advantages. There are so many benefits senior citizens may be able to get from this health program. In a particular perspective, it can simply become the most sensible way for patients to get the service they need even if they are not within the parameters of a normal health institution. There are several advantages for the elderly if they are to avail the home nursing service. The first of which comes in the aspect of convenience. As what that program intends to accomplish, nursing aides and caregivers will be able to provide their services in an extended time since they will be staying at the current home where the patient is situated. Because of such arrangement, patients will be able to get immediate attention for whatever needs they may request. Because of the high rate of monitoring time that the elderly can get from professionals, they can be assisted in doing almost all ordinary tasks that may be too difficult for them to handle by themselves. According to the facts in the Thomas Day report, some of the top rating nursing home assistances tabulated were bathing, dressing, managing personal possessions and managing money.Another good benefit for the elderly in availing these nursing home services can be attributed on the aspect of cost. Apparently, most nursing home facilities were already designated to have special arrangements with various insurance companies and Medicare as stated by Terrence Moynihan of Vitalco. Actually, it can be more cost effective on the part of the patient and his family to acquire external services without the need to consolidate all their money in paying for services from a third party institution. Many of the patients are subsidized in a particular time frame by institutions which are connected to the healthcare programs both public and private entities. Moreover, nursing home institutions accredited by the government can somehow provide the same facilities which hospitals have. Of course, these utilities like those in hospitals can be very expensive at first glance but can be very reasonable according to Consumer Information about nursing facility myths. If an elderly is recovering from a particular illness, surgery or other physical factors, additional benefit can be realized. While it is already important to have a very good system which will look after the welfare of the patient, it is also vital that emotional and social aspects be nurtured. Obviously, elderly people suffer from a great change in their philosophy in life which may affect their relationships with their immediate family members. According to the University of Texas publication, late life mentalhealth can also change dramatically. However, in a home nursing facility, they may be able to interact with other patients and other people to whom they can easily share experiences, have small conversations with and maybe even develop g ood bonds of friendship. Thus, the patient will not just be healed physically but emotionally as well. One last advantage of a nursing home program for the elderly is that the overall health standing of the patient can be easily accessible and conveniently retrieved by parties which concern the welfare of the patient. For example, since the nursing home facility will be able to track down and take note of the progress of the patient, it will be much easier for the facility and other health care institutions to coordinate with each other if the exchange of information will be needed in the future. If a patient will need to undergo a special treatment or healthcare process in a hospital or clinic, then the departments concerned can easily recover records from other health care facilities for faster decision making on how to address the needs of the patient. In terms of health care, information can be a very important commodity especially if the situation of the client worsens. In some s ituations, ease in transfer may also be sighted as a good implication in availing nursing home services. To make it more practical, some institutions were authorized to have a â€Å"dual registration†. These enable the patients to avail both residential and nursing home services without the need to change locations according to the Devon County CouncilGiving the proper care to the elderly using the most effective alternatives in realizing the intention can become one of the most significant goals of the society to further improve the integrity of its social responsibility to the aged. Because of the creation of nursing home facilities, patients can now enjoy to acquire the best possible services for all their needs.ReferencesConsumer Information. 2005. Leading restaurant chains Essay Example

Leading restaurant chains Essay Example Leading restaurant chains Essay Leading restaurant chains Essay Essay Topic: Chains McDonald s is one of the taking eating house ironss in the universe, touching the lives of people mundane. The long journey of the Burger trade name started in 1940, when two brothers, Dick and Mac McDonald opened the first McDonald s eating house in San Bernardino, California. Initially, they owned a hot dog base, but after set uping the eating house they served around 25 points, which were largely barbequed. It became a popular and profitable adolescent haunt. In 1948, the brothers closed and reopened the eating house to sell merely beefburgers, milk shakes and Gallic french friess. As per the information of the McDonald s history, the major gross came from beefburgers, which were sold at a nominal monetary value of 15 cents. The eating house bit by bit became celebrated and the McDonald brothers begin franchising their eating house in the twelvemonth 1953. The first franchise was taken by Neil Fox and under it ; the 2nd Mc Donald s eating house was opened in Fresno, California. It was the first to present the Golden Arch design. The 3rd and 4th eating houses were opened in Saginaw, Michigan and Downey, California, severally. The latter is the oldest Mc Donald s eating house still in operation. In 1954, an enterpriser and milkshake-mixer salesman, Ray Kroc, acquired the franchise of McDonald s eating house for outside California and Arizona. In consequence, Kroc opened his first and the overall 9th eating house in Illinois, Chicago, and gave birth to Mc Donald s Corporation. In 1958, the eating house concatenation sold its 100 millionth beefburger. In 1960, Kroc renamed his company as McDonald s Corporation . In 1961, Kroc convinced the McDonald brothers to sell the concern rights to him for a sum $ 2.7milion. Subsequently that twelvemonth, the Hamburger University was opened, which gave away McDonald s eating house Bachelor of Hamburgology grades to pupils. In 1963, the mascot Ronald McDonald was born as a portion of a selling scheme in US. In 1967, the first eating house outside US was opened in Richmond, British Columbia. In 1974, the 3000th eating house opened in Woolwich, United Kingdom, which is the first of the state. Happy Meal was introduced in US in 1979. In 1984, the company became the chief patron of the Summer Olympics. The twelvemonth was besides marked by the decease of Ray Kroc. In 1988, the first eating house opened in a communist state in Belgrade, Yugoslavia, followed by the first Soviet eating house in Moscow ( 1990 ) . In 1992, the largest McDonald s was opened in Beijing, China, holding over 700 seats and was subsequently demolished. In 1993, the first sea-going eating house was established, aboard the Finnish Cruise-ferry Silja Europa, sailing between Helsinki and Stockholm. In 1994, McDonald s bagged the Catalyst Award for its plan for fostering leading development in adult females . In 1996, the first Indian eating house was opened. In 2003, the company launched the I m lovin it run. In 2005, McDonald s started its McDelivery service in Singapore. In 2006, the concatenation announced that it will print nutritionary information on its packaging of all its merchandises, for the benefit of the clients. Sing the immense success and trade name McDonald s has become, the nutrient concatenation is spread across the universe in about all the major metropoliss of the Earth. Being economic and user friendly, the success rate of the company can non be doubted. McDonalds Canada opened in 1967 ; thirteen old ages after McDonalds had taken the United States by storm. This was the first eating house to be opened outside of the United States. It was in 1965 that McDonalds went public and offered portions on Wall Street. Since so it has been of import for McDonalds to continually supervise its public presentation, to do certain it is competitory and profitable piece besides being cognizant of its immediate community duties. This can be achieved by utilizing the Porters 5 Forces theoretical account so the company is able to find where its concern demands to alter or better in order to remain competitory in the fast nutrient industry. Analyse McDonalds utilizing a well known theoretical account to measure the competitory place that it occupies within its industry.Porter s competitory forces theoretical account includes five forces that need to be analysed. These forces include the strength of competition from traditional rivals, menace of new market entrants, menace of replacement merchandises and services, dickering power of clients and dickering power of providers ( Laudon A ; Laudon, 2007 ) .

David Foster Wallace on SNOOTS - Extreme Usage Fanatics

David Foster Wallace on SNOOTS - Extreme Usage Fanatics After reading this article, decide if you are a SNOOT: one of the Few, the Proud, the More or Less Constantly Appalled at Everyone Else. Question: What Is a SNOOT? Answer: SNOOT (n) (highly colloq) is this reviewers nuclear familys nickname clef for a really extreme usage fanatic, the sort of person whose idea of Sunday fun is to hunt for mistakes in the very prose of [William] Safires column [in The New York Times Magazine]. This definition of the family word SNOOT (an acronym for Sprachgefà ¼hl Necessitates Our Ongoing Tendance or Syntax Nudniks of Our Time) appears in footnote number five of David Foster Wallaces review article Authority and American Usage (in Consider the Lobster and Other Essays,   2005). There, the late author of Infinite Jest devotes more than 50 smart and entertaining pages to the topic of grammarin particular, to the dispute between linguistic conservatives and linguistic liberals, otherwise known as the Prescriptivists vs. the Descriptivists. Before deciding whether you would feel comfortable characterizing yourself as a SNOOT, consider Wallaces description of SNOOTitude: There are lots of epithets for people like thisGrammar Nazis, Usage Nerds, Syntax Snobs, the Grammar Battalion, the Language Police. The term I was raised with is SNOOT. The word might be slightly self-mocking, but those other terms are outright dysphemisms. A SNOOT can be defined as somebody who knows what dysphemism means and doesnt mind letting you know it.I submit that we SNOOTs are just about the last remaining kind of truly elitist nerd. There are, granted, plenty of nerd-species in todays America, and some of these are elitist within their own nerdy purview (e.g., the skinny, carbuncular, semi-autistic Computer Nerd moves instantly up on the totem pole of status when your screen freezes and now you need his help, and the bland condescension with which he performs the two occult keystrokes that unfreeze your screen is both elitist and situationally valid). But the SNOOTs purview is interhuman social life itself. You dont, after all (despite withering cultural pressure), have to use a computer, but you cant escape language: Language is everything and everywhere; its what lets us have anything to do with one another; its what separates us from the animals; Genesis 11:7-10 and so on. And we SNOOTS know when and how to hyphenate phrasal adjectives and to keep participles from dangling, and we know that we know, and we know how very few other Americans know this stuff or even care, and we judge them accordingly. In ways that certain of us are uncomfortable about, SNOOTs attitudes about contemporary usage resemble religious/political conservatives attitudes about contemporary culture: We combine a missionary zeal and a near-neural faith in our beliefs importance with a curmudgeonly hell-in-a-handbasket despair at the way English is routinely manhandled and corrupted by supposedly literate adults. Plus a dash of the elitism of, say, Billy Zane in Titanica fellow SNOOT I know likes to say that listening to most peoples public English feels like watching somebody u se a Stradivarius to pound nails. We are the Few, the Proud, the More or Less Constantly Appalled at Everyone Else.(David Foster Wallace, Consider the Lobster and Other Essays. Little, Brown and Company, 2005) As regular visitors to this site may have noticed, we strive to remain on speaking terms with both sides in the Usage Wars. Looking at how language works (description) happens to interest us more than laying down arbitrary laws on how language should be used (prescription). And yet its clear that most readers arrive at About.com Grammar Composition in search of rulings, not linguistic ruminations, and so we do try to be accommodating. But how do you define your interest in language? Are you a fan of Lynne Trusss Eats, Shoots Leaves: The Zero Tolerance Approach to Punctuation (2004), or do you feel more at home with David Crystals The Fight for English: How Language Pundits Ate, Shot, and Left (2007)? Are you inclined to fuss at a child who uses aint, or are you more interested in finding out that until the 19th century in both England and America aint was an acceptable usage? In short, do you consider yourself a SNOOT?

Environment and famiy dynamics Essay Example | Topics and Well Written Essays - 250 words

Environment and famiy dynamics - Essay Example With respect to what factors constitute an environment, a simpler analysis would be to conclude that any and all outside forces that help to shape the development of the family should be considered the environment. With such an all inclusive meaning, it is readily understood that the environment has a profound effect on familial development as a function of the fact that it encompasses so many diverse factors. Likewise, familial communication is one of the most central mechanisms through which a family can hope to discuss, analyze, and work to ameliorate negative environmental factors. Without open communication within the unit, the environment itself becomes the determinant factor towards shaping the overall functionality/disfunctionality of the given family unit. In this way, the communication mechanism works to regulate the way in which the familial unit works to alleviate environmental pressures that exist upon

Human Resources Project 1&2 Assignment Example | Topics and Well Written Essays - 1500 words

Human Resources Project 1 - Assignment Example This information can be used to understand the career opportunities in the company. A deeper analysis reveals that the HR policies are guided by the main HR policy statement of Nestec Ltd (2002). This is the Nestle Human Resources Policy, implemental to all subsidiaries of the company including those in USA. 2. The company is Nestle Waters North America, and its HR policies appear to be based on the Nestle Human Resources Policy document. I think some updating is needed for this set of HR policies. 3. In order to update the set of HR policies of Nestle Waters North America to optimize its North American operations flexibly with respect to the main policy framework of Nestec Ltd, it is mandatory to embark on a qualitative research followed by a number of activities for drafting and proposing some viable HR policy updates. The activities are described below: I. Interview of the current employees II. Interview of and discussion with the HR managers III. Analysis of current policies with regard to existing academic and business literature IV. Preparation and presentation of the new and/or updated policies in a proposal format V. Briefing the top HR managers 4. In this section, a proposal that describes the types of policies that are to be prepared and/or changed will be discussed. A close examination of Nestle Waters NA’s (2006) HR policies reveals that they are highly dependent on the HR policy manual of Nestec Ltd. First of all, one of the biggest drawbacks of these policies is that they put certain restrictions on the role of the HR managers. According to Nestec Ltd (2002, p. 4), â€Å"HR managers and their staff are there to provide professional support in handling people matters but should not substitute themselves to the responsible manager.† This sort of approach is rather traditionalistic. The second point is that Nestle Waters NA (2006) maintains strict control over its all hiring and training operations. However, relatively recent experience of certain companies shows that outsourcing the HR responsibilities can bring about more concentration on the vertical specialties of the company (Tornbohm and Da Rold 2005). So these two HR approaches need to be changed. A tentative timeline of the proposed HR policy updating and implementation task is provided in Table – 1. Table – 1 A Tentative Timeline of HR Policy Update and Implementation Program Task Time Task – 1: Interview of current employees (at least 20 to 30 employees randomly selected) 7 days Task – 2: Interview of and discussion with the company’s current HR managers. This will involve one to one interaction 7 days Task – 3: Existing policies are to be analyzed. This will involve correlating the existing practices with external case studies as available in different business journals, magazines, etc. 4 days Task – 4: Preparation and presentation of new policies (final draft) 3 days Task – 5: Briefing the HR mana gers before the plan is rolled out. 2 days Total time taken +2 reserve days to compensate loss of time (if any) in the course of the project Total 3 weeks and 4 days (approx) Project Part 2 Updating the existing HR policies First, HR managers must not be constrained in their HR specific roles only with such a strict regulatory approach. At the first place this makes the hierarchic system of the corporation too strong. The HR managers must be given some of the company’s specialties based training. For example, HR managers can be given some basic training on mineral water processing and manufacturing at

Socrates, Are You Happy Term Paper Example | Topics and Well Written Essays - 1500 words

Socrates, Are You Happy - Term Paper Example Human perfection is thus a product of perfection of the intellect. The following paper discusses the just occasion of Socrates’ view that a morally good person is happier than the morally bad person. This will be followed by a personal philosophical worry related to his justification. DISCUSSION Socrates’ view of the relation between virtues and happiness is that good morals are necessary for the fulfillment of life happiness. He believed that an honest, fair, wise and self controlled individual will merit praise and respect from other people thus contributing to achievement of happiness. Portraying virtuous behaviors towards people does not guarantee moral reciprocity. In such a case, Socrates’ view makes one wonder whether nasty responses to virtuous deeds are an aspect of happiness. Consequently, morally potent people have a tendency of leading a life filled with fun and joyous experiences. In this perspective, happiness emanates from the belief that their act ions are for the life betterment and satisfaction. Everything that brings satisfaction is an agent of happiness not unless one is missing out on the different forms of happiness. However, he counters this by suggesting that normal happiness makes one think that they are happy whereas real happiness stems deeply inside the soul. He portends, "The Olympian victor makes you think yourself happy; I make you be happy" (West 36-37). Socrates affirms that true happiness extends beyond external wealth and worldly possessions. He asserts, â€Å"Wealth does not bring about excellence, but excellence makes wealth and everything else pleasurable for men† (West 30). This implies that it is impossible for one to buy perfect happiness through material possessions. Socrates views virtue and soul as a means to a healthy and flourishing after life and the evil tendencies associated with an individual have the ability to destroy the soul leading to future unhappiness. He believes in the existen ce of a higher power that rewards and punishes good and bad deeds in the after life. This rhymes with his affirmation that morally upright individuals will lead a happy life both currently and in the after life. Amid his belief in the existence of the after life, Socrates does not believe in any sacred scripture or religious myths (Leibowitz). The lack of credible proves of the existence such an after life after death compromises the logic that individuals abiding to the moral virtues will experience a happy after life. Does this means that one has to endure painful experiences that may be associated with maintenance of virtuous principles to deny he or herself satisfaction in the current life for an after life? According to Socrates, wisdom is the centrally significant aspect of happiness. He maintained, â€Å"The unexamined life is not worth living† (West, 38). Evil, people lack an aspect of reflection in the way they lead their life thus wasting the capacity of critical th inking that enables one choose between vices and virtues. They only indulge in those activities that please their body without an analysis of the far reaching effects of their actions. Virtues cannot be developed without wisdom implying that virtuous individuals stand a better chance of cultivating long lasting happiness than evil people. Moreover, wisdom is required for an individual to know whether what they are pursuing in their life will

The Battle of the Bulge Essay Example | Topics and Well Written Essays - 750 words

The Battle of the Bulge - Essay Example It had the aims of annexing and capturing France, Luxemburg and Belgium. The major front through which the encroachment was made included the Ardennes Forest. The aims were to take the enemy by surprise. Since the Germans had a knack of taking the rivals by surprise and gifted with the Blitzkrieg and other war instruments, the aims were to repeat the heroics that they had done so in the first phase of the Second World War when it overtook the minnows of the war in no time. Over two hundred and fifty thousand troops were engaged in this battle by the German high command and the point was clear, it had been done to break the sequence of frustration pouring events that had recently taken place in the course of Second World War. The battle had its repercussions upon the Western powers, United States of America and Germany. Each was deeply moved through the battle, it is therefore termed as one of the most critical points of war in those days of the entire episode of Second World War. The significance of this battle was the fact that the Western powers and their allies were caught completely off guard, they had little expected this and had no war insight of this one coming, as a result the impact fell upon the number of casualties suffered and other major losses incurred in the entire events that unfolded in this particular battle. United States also suffered damages in this particular battle. The battle had a direct impact on the German side as well. Having invested heavy in to this expedition, the Germans had to compromise on other fronts and in other battles in order to compensate for the manpower and the financial funds and armaments that were made for this particular endeavor undertaken. The main target was the American army’s 106 Division (Spiller, p 79). It did not enjoy great expertise or experience of such critical moments and it thereby failed to provide and deliver the heroics that were expected of

Comprehensive Question (Communication Theory) Essay

Comprehensive Question (Communication Theory) - Essay Example e present text looks at the accepted standards of a good theory such as validity, theological scope, franchise and heuristic value to value the symbolic interactionism theory. It also dwells on criticisms leveled against the theory. The theories contemporary application has been discussed in detail. The text also entails Em Griffin’s take on the communication theory and its relevance. He pays tribute to Herbart Mead who was a leading theorist. People act towards things based on the meanings they attach to those things. Different things have different meanings to different people. People derive meanings from social interactions and are modified through various interpretations. Social interaction is the process by which people act and react to other people in their environment. In this perspective, social interaction encompasses the actions of people towards others and the responses they get in return. Symbolic Interactionism theory meets most of the accepted standards of a good theory despite its criticisms. Em Griffin posited that most communication theorists used Mead’s intellectual guidelines to develop their theories (Griffin, 2011). George Herbert Mead was a pioneer in the development of the communication theory. Whereas the Symbolic Interactionism theory face criticisms across time and place, it is critical to evaluate it based on standards and show its applications in the contemporary world. Symbolic Interactionism studies how people interact with each other owing to their adaptive social behavior. In this perspective, social structures are best understood in relation to basic level of individual interactions. Charles Horton Cooley in collaboration with George Herbert Mead came up with the theory (Turner, 2006). According to this theory, the meaning and worth of objects, occurrences and behaviors come from people’s interpretations, which vary from one group to another. Cooley argues that people adapt the way they think about themselves based on how

Obscenity and pornography Essay Example | Topics and Well Written Essays - 250 words - 1

Obscenity and pornography - Essay Example For her, the court can discredit the victim’s rape allegation by â€Å"finding discrepancies in the victim’s story and assuming ulterior motives for reporting the assault†; for this the court can take into account such resources as the â€Å"official reports and records, typifications of rape-relevant behavior, and knowledge of the victim’s personal life and criminal connections† (Frohmann, 1991, p. 213). Thus, the prosecutor-victim complaint filling interview acts as a n integral part of the sexual case processing. Similarly, another major method employed by the legal system to discredit sexual assault cases is by analyzing the accusers mental health records and by offering the defendant an opportunity to prove his innocence. Cases are rejected once the court gets convinced that the victim does not have a good previous mental health record. This rape shield legislation plays a dominant role in sexual assault cases. Another widespread and common met hod employed by the legal systems to reject sexual assault cases is by identifying congruencies in the charges filed by police at arrest with the charge filed by the prosecutor. When there are such evident congruencies, the court can either reject sexual assault cases or discredit victims’ allegations of sexual assault. Therefore, one should bear in mind that mere allegations can easily be rejected by the courts in the case of sexual assaults. Psychology and Perspectives Essay Example for Free

Psychology and Perspectives Essay Human beings are given the unique capacity to view things not just the way they are but also on the pre-programmed processes we use in describing a situation. These perspectives can come from many different external influences and by internal factors involving our personal and historical development. On these reason we can employ psychology to study why and how we view things and how these factors influence our perspectives. There are many psychological perspectives presented in the field to distinguish our differences from other people. However, though we have been guided by these explanations on how we react mentally and physically over a situation, these perspectives, though they are limited, complement each other to form a unified explanation on our views. Their questions present different answers which can describe the paradigms of human existence and process, based on the different aspects of their functions and influences. This paper will discuss several psychological perspectives and their relationship to our daily routine of looking at things differently from others. View point and summaries of related topics will be discussed applied with the neuroscience, evolutionary, psychodynamic, behavioral, behavior genetics and cognitive perspectives. These perspectives are best to explain the differences people have on viewing a situation. Neuroscience Perspective First, the neuroscience perspective looks at the internal viewing functions of a person. This involves the processes of the brain in conceiving a situation and the underlying influences that affect a persons behavior. It describes how the body and mind control our emotions, memories, and sensory processes to react on a given situation. In The Girl with a Boys Brain by Carlin Flora, neuroscience perspective is used in determining a persons tendencies and irregularities by identifying brain processes and disorders.   Kiriana Cowansage has had obsessions and successes in many areas of her life. However, though her brain is above the average intellectual norm, she often gets lost in her own neighborhood. She is then diagnosed to have Aspergers Syndrome, a mental disorder highly functional in the autism family. This condition is found usually on boys due to their innate tendency to systematize. Kiriana is said to be weak in relating with other people and in situations she is in. Often times she gets confused by unfamiliar events and get lost helplessly in it due to her faulty sensory processing systems. Kirianas behaviors are apparently affected by her condition and needs attention on how inner processes to solve her problem. This inner view to explain a persons behavior and practices is described in neuroscience perspectives. Evolutionary perspective Evolutionary perspective relates our ancestral environment to be affective of our behaviors at present. The historical development of people and their retained and their passed characteristics are considered to be factors that affect their emotions and tendencies. Evolutionary psychology taps on the affective structures of human ancestral environments on the establishment of emotions, personalities, cognitive processes, and mental disorders (Nesse, p6). In a Psyched for Success article publsihed in October 2003, evolutionary perspective is used in describing the causes and implications of depression. There they raised the question of whether depression is simply a disorder or a sign of emotional fatigue. The article states that, in centuries past, aspects of human life have been internalized and passed through generations to our present life. These aspects of the past are still being used but are insufficient or inappropriate because of our more complicated present. Depression is said to signal this mismatch between our old ways and our new situations (2003). Since life today are relatively harder, people cannot cope completely with new and unfamiliar events presented to them thus causes stress and signals a people to step back and reassess the situation and their reaction. Psychodynamic perspective Psychodynamic perspective asserts that inner conflicts of the past affect a persons behaviors and emotions at the present. It is based primarily on Freuds concept of the unconscious where all repressed feelings are stored and affect our views unnoticeably. People who have abusive and violent experiences in the past are more likely to have repressed emotions stored in their unconcious and these defines who they are in the present. The article In the Name of Love describes adult relationships to be greatly affected by peoples relationships during childhood. Johnson and Maranos report relates the attachment theory of infancy, the characteristic of a child to rely and depend on an immediate relative, a mother usually. This attachment is then carried as children grow old and establish their own relationships with other people (Johnson and Marano, 1994). Partners rely on each others affection and availability. When people are in fear or anxiety, they will certainly ask for support from their partners. Children and adult relationships are underlined by the common need of a person for attachment and security. Behavioral perspective Most of the time there are environmental stimuli that automatically or force us to make a reaction. Behavioral perspective describes this immediate factors as affective to ones behavior. Psychotherapy utilizes this perspective to describe a persons behavior through various stimulus and on many occasions it is used to erase or establish a behavior in a person. In an article by Tim Bower and Robert Epstein, behavioral perspective can detect psychological disorders on patients and consequently affect a therapists own personality. Due to the reinforced and repeated exposure to the cases and situations of patients they treat, therapist have a tendency to absorb behaviors and manifest it in their own lives. In a certain instance, psychologists who experienced having a patient suicide felt guilt and self-incrimination which could lead to other unprofessional behaviors. Also, the distress caused by their patients faulty disclosures have affected their lives with their own families the same with how their family relationships affect their professional responsibilities. Also, mental health workers are at greater risk of substance abuse due to their treatment of patients with the same behavior (Epstain and Bower, 1997). Genetic behavior perspective The genetic behavior perspective relates to the innate causes of behaviors. The hereditary influences that people often are affected in their responses to stimuli are regarded with much research and attention to prove. The concept of being born and not made can be found on this perspective as what the article Bruce Avolio explained. In Are Leaders Born or Made?, he stated that genetic codes also contain behavioral preferences and tools for people be what they are â€Å"meant† to be. Leaders are equipped with high energy, desire to affect others, determination and intelligence. Scientist have spent time and effort in proving that these qualities are innate and   are gifts to chosen individuals tasked become leaders. However, these characteristics are later found with the possibility of being learned and instilled to us by our parents at the early stages of life (Avolio, 1999). Also, in the article, My Genes Made Me Do It, Peele and DeGrandpre genetic codes programmed with certain behaviors are being used as excuse for tolerating certain actions (Peele and DeGrandpre , 1995). Often times, people are fooled with wrong theories on genetic behaviors and on this note researchers are focused on specific areas of life which can really be passed genetically. Also, if our personality is already determined during the early stages of conceiving, people tend to withdraw efforts on changing their behaviors. This perception is considered to have monumental consequences on how we view ourselves and on personal development. These psychological perspectives – neuroscience, evolutionary, genetic behavior, behavioral, and psychodynamic – are established to have various views on how human beings behave and relate to others. Though these perspectives raises differing questions and answers, they all relate a persons process and structure for behavior. The study on these perspectives not only open various doors for psychological exploration but also give different means on how to describe personalities and offer treatments on the disorders which haunt people over the course of their life by identifying the internal and external etiologies of their abnormalities. Also, these only prove that wherever human perspectives are present, psychological approaches can be utilized to determine the wide range of causes and influences of these views.

The Next Big Thing What Is Pinterest Marketing Essay

The Next Big Thing What Is Pinterest Marketing Essay Pinterest is a website that lets individuals or businesses gather and share the numerous interesting items, pictures, videos, or anything that interests them; It is essentially a community of curators (Pinterest, 2012, p.1). The term pin refers to posting or placing an item on your pinboard (Pinterest, 2012, p.1). Individuals use pinboards to beautify their households/offices, design their weddings, learn about new recipes, and other interesting things (Pinterest, 2012, p.1). The website allows users to browse through other pinboards of individuals or brands; browsing through pinboards is an exciting way to discover new ideas (Pinterest, 2012, p.2). Pinterest users are encouraged to interact with the content by repining it, sharing pins on Facebook and Twitter or via email, and even embedding individual pins on their website or blog (Hubspot, 2012, pg. 9). . 1.1 Brief History of Pinterest Pinterest was created by a company called Cold Brew Labs in 2009 (Carlson, 2012, pg. 1). Cold Brew Labs initially consisted of three founders, but a couple of months later it consisted of only Ben Silberman and Paul Sciarra (Carlson, 2012, pg. 1). It has since grown to become one the best and most used social media platform. As of Fall 2012, Pinterest had over 11 million users, of which up to 80% of the users are women between the ages of 25 and 55 (Hayden, 2012, p.1). According to Beth Hayden (2012), the demographic is shifting and there are more men joining Pinterest, she also goes on to talk about how Pinterest users are fairly affluent, with an average salary of $50,000. 1.2 SWOT Analysis of Pinterest The major strengths of Pinterest are its users, its fun and easy interface, its ability to increase traffic, ability to increase sales, and its abilty to link and lead (Hubspot, 2012, pg. 9-12). The major weaknesses of Pinterest are spams, the fact that it is not on all smartphones, and also the fact that they are yet to develop a clear, effective revenue mode (Hubspot, 2012). Opportunities available for Pinterest are take over/mergers, more mobile apps, and. Threats are clone sites, biggers sites like google, facebook (Hubspot, 2012). 2. How Are They Influencing Social Media? 3-5 years ago an average online customer would have to ask friends or professional for wedding tips, home dà ©cor tips, or even food tips. Today, Pinterest is changing the way we access information, we no longer need to pay a professional for wedding tips, home dà ©cor tips, etc. However, the main question is how does that influence social media? Well, Pinterest has filled the void social media giants Facebook and Twitter have failed to fill by providing consumers and sellers the perfect medium to exchange ideas visually. At present, Pinterest is driving more referral traffic than LinkedIn, Google+ and YouTube combined, the only social media platform driving more traffic than Pinterest is Facebook (Hayden, 2012, p.11) Pinterest, whose users have been proven to buy more items, spend more money, and complete more transactions online than any other site (Crum, 2012, p. 2). In short, the people who use Pinterest are the ones at the heart of every social media outlet on the market these days, and what theyre looking at and buying is critical to any successful merchant (Crum, 2012, p. 2). 3. How Can Businesses Effectively Use Pinterest Pinterest presents businesses with a variety of activities you can initiate to market your company to a new audience (Hubspot, 2012, pg. 22). The goal is to increase or attain brand recognition, drive traffic to your website and be successful at transferring the new visits into leads and/or sales (Hubspot, 2012, pg. 22) Pinterest is an awesome social media platform for businesses that rely on high-volume of website traffic to increase sales. In fact, early research indicates that Pinterest is more effective at driving traffic compared to other social media sites, even Facebook (Hubspot, 2012, pg. 10). At the end of the day, whats going to matter most is how much traffic, leads, sales, and customers you generate via Pinterest (Hubspot, 2012, pg.27). What is the behaviour of traffic? What topic drives traffic? Analytics tools like Pin Alert, Pinerly, and Pinvolve can help a business monitor and measure growth (Honigman, 2012, p.1). 3.1 How To Drive Website Traffic and/or Sales Via Pinterest First of all, the business has to realize that it has to gain followers, and the easiest way to do this is by becoming an information curator for your niche (Hayden, 2012, p.1). Gather the newest and best resources on your boards. Become a trusted source of information on Pinterest, and your following will grow by leaps and bounds (Hayden, 2012, p.1). Also, Connect your account with your Facebook and Twitter accounts. Not only will it help you gain followers, but making this connection adds social media icons under your profile picture that link to your Facebook and Twitter profiles (Hayden, 2012, p.1). A lot of brands have already started creating contests using Pinterest. Hold a contest that asks users to create a pinboard on their own account to demonstrate what they love about your brand, products, or services (Hubspot, 2012, pg. 25) Make it super easy for website visitors to share your visual content or images on Pinterest by adding a Pin It button to your site (Hayden, 2012, p.1). Just like other social media sharing buttons, this will help to expose your brand to a new audience (Hayden, 2012, p.1). Offer exclusive Pinterest promotions. Create pins that give special promotions for following you on Pinterest (Hayden, 2012, p.1). Create a board that tells the story of your company and communicates your core values. Make this board available to people as part of your sales process (Hayden, 2012, p.1). 4. Brands Already On Pinterest Pinterest offers a great medium to connect with your audience. The brands that have been most successful arent just enabling users to pin their content; rather, theyre getting in on the pinning themselves (Hubspot, 2012, pg. 34) Unlike Twitter, The top profiles, owned by individuals, on Pinterest are over 10 times larger than the top profiles owned by companies, and none are celebrity accounts (business insider, 2012). Individuals who have been successful have kept it simple: Lots of pictures of food and fashion (Minato, 2012, p.2) Pinterest offers a great medium to connect with your audience. The brands that have been most successful arent just enabling users to pin their content; rather, theyre getting in on the pinning themselves. (Hubspot, 2012, pg. 34) Below are 5 brands that are doing well: Perfect Pallete Drake University Mashable Wall Street Journal Whole Foods Market 4.1 What are they doing right? While Pinterest is still very young and its true ROI remains to be seen, here are three examples of brands who are already using Pinterest the right way: to engage fans in a meaningful way that gets them to react, share, and even convert (Hubspot, 2012, pg. 34) The Perfect Palette, a wedding blog that explores the color palette possibilities for your wedding and serves, as a resource for other wedding ideas, would seem to be a perfect match for Pinterest and it is (Wasserman, 2012, p.1). Drake University for instance uses Pinterest to interact with students and help them navigate campus life, they also showcases items its student population might actually be interested in: clothing that matches the schools colors, room dà ©cor perfect for the dorm, guides to making cheap food look and taste awesome, and study inspirations (Hubspot, 2012, pg. 39). If you are a potential student, you can learn everything you need to know about the school with just a few quick glances (Hubspot, 2012, pg. 34) Meanwhile, since Pinterest looks a bit like a newspaper, the Wall Street Journal made it into an actual newspaper. The newspaper takes the most interesting quotes from its articles, highlights them on its Quotes Board and then encourages users to click on them (Minato, 2012, p.1). Food is one of the major niches or shared interests on Pinterest. In fact, food lovers were among the first on Pinterest; they saw the benefits of pinning instead of clipping recipes. These foodies used boards to plan dinner parties, collect holiday baking ideas, and create their own virtual cookbooks (Helm, 2012, p.4). 5. Conclusion As you can tell, the trick to succeeding on Pinterest isnt necessarily about showing off your products or services directly. Its about finding creative ways to show how those products and services fit into the lifestyles of your target audience (Hubspot, 2012, pg. 43). Take the best practices we have shared here and start pinning content that represents your company identity and attracts visitors back to your website (Hubspot, 2012, pg. 43). Finally, dont invest a ton of effort in marketing on Pinterest unless you can measure the results of your activities (Hubspot, 2012, pg. 43). Be smart about the way you prioritize your marketing initiatives and keep a close eye on the specific benefits this new social network can provide to your business (Hubspot, 2012, pg. 43). At the end, it comes down to this: make an amazing product, and people will buy it (Patterson, 2011, p.1)

The Red Badge of Courage and The Blue Hotel :: comparison compare contrast essays

The Red Badge of Courage and The Blue Hotel: The Singular Love of Stephen Crane Stephen Crane firmly cemented himself in the canon of American Romanticism with the success of works such as The Red Badge of Courage and "The Blue Hotel." His writing served to probe the fundamental depths of the genre while enumerating on the themes vital to the movement's aesthetic. Such topics as heartfelt reverence for the beauty and ferocity of nature, the general exaltation of emotion over reason and senses over intellect, self-examination of personality and its moods and mental possibilities, a preoccupation with genius and the heroic archetype in general, a focus on passions and inner struggles, and an emphasis on imagination as a gateway to transcendence, as well as a predilection for the exotic, the remote, the mysterious, and folk culture are all characteristic of his stories. However, the most traditionally "romantic" facets of his artifice are most fully manifested in a series of private correspondence between himself and a certain society maiden by the name of Nellie Crouse. It is these letters that serve to illustrate Crane's writing prowess as it transcends traditional Romantic genrefication. Through these letters, which serve as an informed testament to Crane's marked skill as a writer, we begin to examine Crane in the context of his own existence, devoid of the fictional trappings of his most acclaimed accomplishments. What is most remarkable about Crane's series of letters to Mrs. Crouse is the tone of his love-stricken entreaties. He gracefully plays off of his burgeoning fame and his growing success as a published artist with good-natured self-deprecation and a propensity to undermine his own endeavours. The series of letters commences with a carefully constructed communique crafted to provoke a sympathetic response from Mrs. Crouse. Employing "inside" reactions to his celebrity to impress, he relies on an aura of exotic settings and playful humor to win a reply. Having succeeded in securing an apparently satisfactory response, he eagerly raises the temperature of the correspondence in his second letter. Without compromising further relations with Mrs. Crouse, his words adopt a more acute degree of intimacy, with Crane even going so far as to volunteer to accept her literary advice. The third letter opens to the heart of the correspondence on Crane's side, as he begins in earnest to try and make Mrs.

Discussing Business and Communications

When someone mentions the word communication, one†s thoughts turn to a newspaper, the radio, television, or another more common means of mass-type communication. One does not usually make the connection between communication and other institutions such as business. Good business, however, goes hand in hand with good communication. Good managers and professionals realize that the ability to communicate is not a silly frill; it†s a necessity that helps all accomplish their work (Murphy 2). Therefore the question is often posed: Are these problems of poor communications that face managers and professionals becoming more and more critical? The evidence suggests the answer to be yes- these problems are serious and are growing more and more serious everyday. John O. Morris, a Management Communications Consultant consolidates this problem into a single statement called the Morris Maxim. It states that â€Å"Communications problems grow much faster in any organization than the organization itself grows† (Morris 3). This maxim emphasizes the need for better communication in organizations such as big business through the implication of what would happen if that organization did not fix it†s structure to better handle increasing communication needs. However, before dealing with a solution to the problem of communication in business, (frequently dubbed business speak) it is important to understand how big business operates. Big business was created in the mid-1800†³s to organize corporations such as the railroad, oil and steel industries. At that time, the only other organizations that had a similar size and structure were the Roman Catholic Church and the United States Army. These organizations are extremely authoritative in nature, and use a system of hierarchical communication. This translates into a business organization/communication style which is basically condescending in nature and is based primarily on status . Business speak is often straight, to the point, and beneficial to the individual speaking first, and to others second. This shows its hierarchical origins in that very often, the speaker is one who will use one or more power strategies, mostly the perception that someone can inflict negative consequences. Other issues in business communications include lack of responsibility in the upper ranks of the hierarchy, lack of training in good communications for the majority of employees, and lack of honest, direct conversation between business and it†s customers. These problems need to be fixed for a business to truly succeed, and can be fixed if managers and high-ranking officials take the initiative and implement a few simple and straightforward techniques into their business styles. Current problems facing business communications deal mainly with the apparent lack of functional inter-level communication. That is, communication employees as well as customers can understand. One of the main reasons behind this lack of understandable communication is that there are some many ways to avoid good communication and maintain the status quo for the short term. These mostly pertain to issues brought to a company from outside sources. These include letters of complaint, inquiries from government bodies such as the Federal Trade Commission, and published evaluations (i. e. editorials, product reviews). Instead of addressing these issues head-on and dealing with them, companies are more likely to dodge responsibility. There are 2 main ways to dodge accountability: denial and evasion of responsibility (Benoit, 90). In using denial, a corporation or employee refuses any wrong-doing, and usually transfers blame to another company or employee, often one that is lower on the â€Å"corporate ladder†. This is similar to evasion of responsibility, which often names scapegoats. In addition to that, evasion tactics often claim that any wrong-doing was an accident, or that the intentions behind their actions were good. These tactics allow for excuses to be made and for responsibility to be forgotten. Lastly, some companies will refuse to accept any wrongdoing, and simply fix the problem. This was the case when Tylenol was accused of allowing their merchandise to be tampered by not putting a safety seal on their product†s bottle. This prompted Tylenol†s executives to start sealing their bottles, but they never accepted responsibility for not sealing them in the first place (Benoit 92). This is just one example of a company distancing itself from blame. In order for there to be good communication, corporations must begin accepting responsibility for their actions, and begin making sound business decisions based on what the customer wants and needs. This would be most advantageously served with clear communication between a company and it†s customers. On the whole, communications between companies and customers are based on a â€Å"need to know† basis. There are exceptions to this rule, however. One company has done an increasingly good job in maintaining good communications lines with it†s customers. Intel, Inc. s a computer micro-processor firm that controls over 90% of the computer chip-set industry (Yahoo Tech Headlines). In their annual report, Intel†s top executives announced the creation of a â€Å"sort of R&D lab and strategic think tank to the industry† in which â€Å"we (will) work with PC makers, software developers and PC users to understand their future needs and wishes, and work intensely with industry leaders to develop products or specifications that meet those needs†. In doing so, Intel has opened a direct link to it†s customers, allowing for direct customer impact on some of Intel†s management and directional decisions. However, even the most open and direct company is not without it†s business speak. The following was taken from the same annual report, under the heading â€Å"Taking responsibility for our own growth†: We know we can't wait for growth to come to us. We are responsible for our own future and work to make it as successful as possible by removing roadblocks to PC platform growth, developing preference for the Intel Inside(R) brand among PC users and supporting emerging PC markets around the world. Together, these strategies build value for our stockholders, which is, after all, our most important goal. While this may look like a positive, non-aggressive statement, one finds a different meaning when looking at it from a business speak point of view. The most obvious example of business speak is the phrase â€Å"removing roadblocks to PC platform growth†. Basically stated, Intel wants to buyout or take-over any companies that might stand in the way of allowing Intel to control the industry. If Intel were to come right out and say this, there would be massive investigations from government and consumer groups that would plague Intel for years. Therefore, by tailoring what they tell their customers and stockholders, they are dodging a bullet and enforcing a hierarchical position over it†s customers and stockholders. However, customers are not the only one†s often left in the dark on business decisions. Sometimes, even high ranking officials are not consulted and are left to adapt to a change they had no say in. Such was the case with James Bennett, CEO of Picadilly Cafeterias, Inc. In 1986, then chief financial officer Bennett sat in a meeting and listened as Picadilly†s CEO announced plans to change the recipes of some of their most popular items. These changes were to be unannounced and were never tested or approved internally. There was no communication between the CEO and the company. James Bennett quit later that week and Picadilly†s sales plummeted from $11 a share to $6 (Forbes, 63). In 1992, Bennett was back in action, this time as CEO. He began a comprehensive overhaul that brought back the â€Å"good home cooking† that was the Picadilly tradition. â€Å"I†m just going back to ways that have always worked† (Forbes, 63). Those ways included clear communication between customer and company, as well as between employer and employee. That difference has translated into profit: shares in Picadilly are now worth $14 a piece (Forbes 64). He proved that a business can not be run on a spreadsheet alone. Knowledge in the area of communication, even if at the most elementary level is one of the key factors in a successful employment history. In a survey of 13,586 of its college graduates, General Electric Company found that the great majority of its employees cited written and verbal communication as the college training that had contributed most to their success in business (Zelko 7). It for this reason that many colleges have reported an increase in enrollment in communications classes. In addition to college courses, companies are now beginning to take the initiative and teach their current employees communications skills. This in-service of sorts can be accomplished very efficiently if a few guidelines are met. These include the establishment of an informal and permissive climate, the establishment of the value and importance of the training, and general across-the-board participation- that is, contributions to the group from all of it†s members (Zelko, 8). These guidelines ensure that the environment will be right to help educate the employee that is not versed in communication. This training can be a catalyst in the growth of a business, as well as helping to create a work-friendly environment that encourages productivity (Murphy 9). The American Management Association calls the ability to communicate a â€Å"vital skill of management†, and declare that â€Å"progressive companies now recognize (this ability)†. It is important to improve not only downward communication , but upward communication as well. Values of good downward communication include the ability to help a manager†s authority to be accepted, an evocation of cooperation that helps to solve problems, and a general expression of a more friendly atmosphere that builds morale everywhere (Murphy 281). Values of enhanced upward communication include the ability to forewarn top management of employees† reaction to policies, clarification of directives, and ability to offer valuable ideas to supervisors (Murphy 281). These values can help improve business exponentially, mostly due to the combined efforts of employees and their supervisors. When upward and downward communication has been established, the major problems dealing with communications in business will be eliminated. The hierarchy that is big business will become less prominent, and the business will function much better. A basic analogy that sums up hierarchical structure in business is this- when times are rough, a car that uses both the front and rear tires to move will make out better than a car that uses just the front wheels. Business should be considered a vehicle that has four-wheel drive, not a vehicle with front-wheel drive. In conclusion, communicating in business is one of the leading restraints that a corporation has to deal with in it†s advancement up the ladder of success. However, if a business chooses to hone it†s ability to communicate and increase the level of productivity due to the sharing of ideas all across the corporate ladder, employee and consumer alike will share the increase in quality of a business products, be it computer microprocessors, or cafeteria food. In short, good communication makes good business.

A Discussion on the Renaissance Art and Its Influences Essay

1. The Renaissance style is considered as a collective movement related to the reawakening of art – particularly drawing, painting, sculpture, and architecture – that centered in Italy from 1300-1600 (Cunningham and Reich, 2009, p. 265-266).   This movement evolved over the years as people – tired of the medieval life of poverty and sickness – started to develop new world views.   These world views centered on essential and profound questions related to human beings, their lives, and their purposes in lives.   They formed striking similarities to the Greco-Roman intellectual discourses, which were overshadowed during the dark times of the medieval age but rediscovered during the reawakening period of the Renaissance. Experts agreed that the Renaissance movement started in Florence, Italy, then a trading center between Europe and the rest of the world and a platform for exchange of ideas, purchase of arts, and commissioning of literary works (Cunningham and Reich, 2009, p. 267).   In Italy, people began to question tradition and authority, focus on life on earth, shape their own destinies, educate their selves and revisit the classical teachings from Greece and Rome.   Teachings from Italy were then dispersed elsewhere in Europe and the world through the printing press, a revolutionary invention during the Renaissance (Cunningham and Reich, 2009, p. 265). See more: Homelessness as a social problem Essay One example of a Renaissance art that is a symbol of the inner health of the people during that era was Raphael’s School of Athens (Cunningham and Reich, 2009, p. 315).   This painting pictured the great minds who existed in the city of Athens in Greece – Socrates, Plato and Aristotle – who were gathered in what appeared to be a school.   In the painting, the great minds seemed to be enthralled in a lively exchange of ideas.   Experts said that School of Athens attempted to show that the ancient greats of Greece were as good as the Renaissance men of Leonardo, Raphael and Michelangelo.   In fact in the painting, the three Renaissance artists were supposed to be Socrates, Plato and Aristotle. Another example of a Renaissance art that embodied the dynamism and transformation peculiar to the period was the sculpture of Michelangelo of David when the artist was at a relatively young age of 26 (Cunningham and Reich, 2009, p. 286). David was depicted as a civilized and a thinking individual who contemplates on challenges without immediately resorting to unnecessary brute.   David was said to represent the brightness of the Renaissance man.   It was also said to epitomize the confidence that the people then were feeling in influencing their destinies in terms of trouncing evil and gaining victories. Renaissance humanism is a notion that sprang during this period.   This notion placed emphasis on the capacity of human beings to manipulate their future without overreliance on the church (Cunningham and Reich, 2009, p. 287).   Although much of the art works had religious themes, the works portrayed religious icons as humans.   Such portrayal made light of the religious canons imposed by the church.   Instead, the portrayal highlighted the human spirit and its capacity to elevate to great heights.   One example of an art work that displayed humanism was Sandro Botticelli’s Birth of Venus, which depicted the goddess as an innocent woman with the use of pastel colors.   Another example is Simone Martini’s Annunciation, where an angel painted in realistic human dimensions and appearance appeared to tell Mary that she will bear God’s son. The rebirth of the artistic movement in Italy was largely attributed to the successful businessmen in the city of Florence who fed, trained, educated and provided for the basic needs of the artists (Cunningham and Reich, 2009, p. 268).  Ã‚   These patrons commissioned works based on clear-cut agreements. The powers of these businessmen from the Medici family stretched all the way to Rome, allowing many artists to secure contracts to accomplish religious works of arts for the Catholic Church.  Ã‚   The patronage of the Medici family for the artists was crucial to the Renaissance as artists were elevated to a stature important to the beautification and strengthening of the culture of Florence.   When the Medici family declined, artists went to Rome where they received the patronage of the pope (Weekly Lectures, n.d.). 3. Prior to the Protestant Reformation, there had been a fierce and widespread sentiment about the perceived abuses of the Catholic Church (Cunningham and Reich, 2009, p. 240).   People felt that the leaders of the church were leading extravagant lives that contrasted with the generally modest, if not poor, living of the majority of the people.   There were classes within the population that wanted to lead  Ã‚  Ã‚   towards positive change.   People were also weary of being caught in the cross-fire of conflicts between the Catholic Church and Kings, both desired power and wealth. To top these off, people were staring to change their beliefs about the capabilities of human beings during the Renaissance. These situations were the precursors to the ushering of the Protestant Reformation, which was set off by German monk Martin Luther.   Luther questioned the corruption and moral degradation in Rome and in the whole of the Catholic Church through his writings in The 95 Theses.   The Church however was not willing to change its ways.   It then financed the Counter-Reformation (Cunningham and Reich, 2009, p. 297). Immediately, art became the medium of propagating the beliefs of the Protestants, who had their bailiwicks in northern Europe, and Catholics, whose strongholds were in the south.   For the Catholics, art must focus on religious contents with certain symbolisms that magnify the holiness of the contents.   The Catholic art was similar to the art that had prevailed in the Middle Ages.   For the Protestants, Catholic religious contents in arts were idolatrous that must be destroyed through iconoclastic movements during the Protestant Reformation. The Protestant art was similar to the art of the humanist Renaissance artists who depicted contents in realistic settings. As a response to the Protestant Reformation, the Catholic Church introduced a Counter-Reformation.   It instituted a few changes within the church but became more austere in regulating heresy.   Regulations covered the arts, sending Catholic painters to produce religious contents similar to those done during the Middle Ages. Content in arts was the distinguishing factor between the Reformation and the Counter-Reformation.   For the Protestants during the Reformation, paintings centered on mundane activities of everyday existence.   Occasionally, paintings drawn out of scenes from the Bible were made.   However, these paintings depicted the religious contents in a humanistic manner.  Ã‚   Simple scenes found in regular occasions were also contained in paintings.   Generally, the contents did not attempt to glorify contents through symbols. For the Catholics during the Counter-Reformation, paintings focused on idealized religious contents that contained symbolisms of holiness, omnipotence, and great glory.   These religious contents were idealized in terms of appearance and the environment in which they were depicted to move.   Painters did not paint flaws.  Ã‚   They likewise veered from common scenes experienced by common people.   Some of the religious contents depicted in the Counter-Reformation included Catholic saints, sacraments, traditions, and codes of belief taught by the Catholic Church. The arts during Protestant Reformation and Counter-Reformation were divergent largely because of the opposing world views espoused by the Protestants and the Catholics.   On one hand, the Protestants believed that man could shape his destiny and approach God because the sacrifices of Christ were enough to save human souls.   On the other hand, the Catholics believed that intermediaries like saints and the Virgin Mary were needed to help Catholics approach God and enter the gates of heaven. Because intermediaries were needed, Catholics created relics where divine powers were supposed to reside.   A form of these relics is a typical painting created during Reformation.   Catholics worshipped the relics and sought from these relics intervention in order to get the graces of God. Because Protestants believed in the value of man and Christ’s sacrifices, they loathed these relics and called these relics channels of idolatry.
